1. About this statement

Van Caem Klerks Group (“Van Caem Klerks Group”, “we”, “us”) respects your privacy and handles personal data with care. This statement explains what personal data we collect through our website at caemklerks.com and in the course of our business relationships, why we collect it, how long we keep it, and what rights you have.

This statement applies to:

  • visitors to caemklerks.com;
  • people who contact us through the website, by email or by telephone;
  • representatives of our customers, suppliers and business partners;
  • applicants for positions with us.

It does not apply to our own employees, who receive separate information, or to third-party websites we link to.

3. What we collect, why, and on what basis

3.1 Contact form

Our contact form at caemklerks.com/contact collects your name, surname, company name, telephone number, country, email address, the division your enquiry relates to, the type of enquiry, and your message, together with your acceptance of our terms.

We use this to answer your enquiry and, where relevant, to follow up on a possible commercial relationship.

Legal basis: performance of a contract or steps taken at your request prior to entering into one (Art. 6(1)(b) GDPR), or our legitimate interest in responding to business enquiries (Art. 6(1)(f) GDPR).

How your submission is handled. Your submission is emailed to an internal Van Caem Klerks Group address, and a copy is retained in our website’s database so that enquiries are not lost if an email fails to deliver. Database copies are deleted quarterly. Nothing is sent to any third party.

3.2 Enquiries by email, telephone and post

If you contact us directly we process the contact details and content you provide, for the purpose of handling your enquiry.

Legal basis: Art. 6(1)(b) or Art. 6(1)(f) GDPR, as above.

3.3 Business relationships

In the course of trading we process the business contact details of representatives of our customers, suppliers and partners — typically name, job title, employer, business email address, business telephone number, and correspondence. We also process the information needed to perform contracts, meet our tax and customs obligations, and carry out sanctions, export-control and know-your-customer checks where these apply to our trade.

Legal basis: performance of a contract (Art. 6(1)(b) GDPR); compliance with a legal obligation (Art. 6(1)(c) GDPR); and our legitimate interest in maintaining and administering commercial relationships (Art. 6(1)(f) GDPR).

3.4 Job applications and the vacancies feed

Our Careers page displays our current vacancies through a feed supplied by SociableKit, which reproduces the job postings from our LinkedIn company page.

This feed is treated as a statistics technology and is blocked until you consent to statistics cookies. If you decline, the feed does not load, no identifier is stored in your browser, and no data is sent to SociableKit.

If you apply for a position with us, we will process the personal data contained in your application. Information not relevant to assessing your suitability, such as a photograph, religion, race, or age, is disregarded if incidentally included. A DPIA is not required for this processing, as applications are reviewed manually without automated decision-making.

Legal basis: steps taken at your request prior to entering an employment contract (Art. 6(1)(b) GDPR), and our legitimate interest in assessing suitability (Art. 6(1)(f) GDPR).

Retention: we keep application data for four weeks after the procedure ends, or one year with your consent.

3.5 Website analytics

With your consent we use Google Analytics 4, deployed through Google Tag Manager, to understand how visitors use our website so that we can improve it. This uses cookies and similar technologies that record pages visited, approximate location derived from IP address, device and browser type, and referral source.

Google Analytics does not run, and sets no cookies, unless you have given consent for statistics cookies. We operate Google Consent Mode, so the analytics tag is held back until a consent signal is present. Withdrawing consent stops the collection and removes the cookies.

Legal basis: your consent (Art. 6(1)(a) GDPR), obtained through our cookie banner. You can withdraw consent at any time — see section 4.

Our consent management platform, Cookiebot (by Usercentrics), records your cookie preferences, together with a consent identifier, your IP address, the date and time, and the choices you made. We are required to be able to demonstrate that valid consent was given.

Your recorded choice is kept for 12 months, after which you will be asked again.

Legal basis: compliance with a legal obligation (Art. 6(1)(c) GDPR) in conjunction with Art. 7(1) GDPR.

3.7 Maps

Our contact page embeds a map provided by Google. When the map loads, Google may receive your IP address and set cookies.

3.8 Server logs and security

Our hosting provider records technical data for every request to the website, including IP address, timestamp, requested URL, response status, referrer and browser user agent. This is used to keep the site available and secure, to detect abuse, and to diagnose faults. Our website security software also records IP addresses associated with suspicious activity in order to block it.

Legal basis: our legitimate interest in the security and availability of our systems (Art. 6(1)(f) GDPR).

4. Cookies

We use cookies and similar technologies.

Strictly necessary cookies — the cookie that stores your consent choice, and a local storage item used by our website’s page builder — are placed without consent, because the website cannot function properly without them.

All other cookies and similar technologies, including analytics cookies and the vacancies feed on our Careers page, are placed only after you consent. Our consent platform blocks them automatically until you choose.

We do not use cookies for advertising, and we do not share your browsing data with advertising partners.

A current, itemised list of every cookie in use, its purpose, its provider and its lifetime is published in the cookie declaration below. It is generated automatically from a monthly scan of the website:

Changing or withdrawing your consent. You can change or withdraw your choice at any time using the cookie settings available on this website. Withdrawal is as easy as giving consent and takes effect immediately.

5. Who we share your data with

We do not sell your personal data. We share it only where necessary, with:

  • Group companies within Van Caem Klerks Group, where needed to handle your enquiry or administer our relationship;
  • Third Parties: We sometimes share personal data with third-party service providers, where necessary for the operation of our business, the performance of contracts, compliance with legal obligations, or with your consent. Any such sharing is carried out in accordance with applicable data protection laws and appropriate safeguards.
  • Competent authorities, where we are legally required to disclose.

We conclude data processing agreements with all parties who process personal data on our behalf.

6. How long do we keep your data

7. Transfers outside the European Economic Area

We may transfer personal data outside the European Economic Area (EEA). Where we do, this is based either on an adequacy decision issued by the European Commission (such as the EU-U.S. Data Privacy Framework, under which our analytics provider, Google LLC, is certified), or on appropriate safeguards such as Standard Contractual Clauses. Occasional transfers made in the course of ordinary business correspondence rely on the relevant exception under Article 49 GDPR.

You may request a copy of the safeguards we rely on by contacting us at the address in section 2.

8. Security

We apply appropriate technical and organizational measures to protect personal data against loss and unlawful processing. These include encrypted transport (TLS) for all traffic to our website, HTTP strict transport security, access control and authentication on our systems, website security monitoring, and restricting access to personal data to those who need it for their role.

9. Your rights

Under the GDPR you have the right to:

  • access the personal data we hold about you;
  • rectification of inaccurate or incomplete data;
  • erasure of your data in the circumstances the GDPR provides for;
  • restriction of processing;
  • data portability, for data you provided to us that we process by automated means on the basis of consent or a contract;
  • object to processing based on our legitimate interests, on grounds relating to your particular situation;
  • withdraw consent at any time, where processing is based on consent. Withdrawal does not affect the lawfulness of processing before it.

To exercise any of these rights, contact us at info@caemklerks.com or at the postal address in section 2. We will respond within one month. We may ask you to identify yourself so that we do not disclose data to the wrong person.

10. Children

Our website and services are directed at businesses, not at children. We do not knowingly collect personal data from anyone under 16.

11. Changes to this statement

We may update this statement to reflect changes in our processing or in the law. The current version is always published at caemklerks.com/privacy-policy, with the date of the most recent update at the top.
